Another tilt at smacking law

Act MP John Boscawen is using his Private Member's Bill to campaign against Prime Minister John Key's stance on the anti smacking referendum.
The Prime Minister's decision to ignore the overwhelming 87.4 per cent vote in favour of a law change is a constitutional issue, says John.

John Key said he wasn't going to change the law, he would make sure the police and the courts enforced the legislation in the way he wanted.
'What I'm saying is it is not up to the Prime Minister to say how the law should be enforced,” says John.
'It is up to Parliament to change the law. It is a major constitutional issue.”
The list MP's Private Member's Bill on the issue was drawn by ballot just three days after the referendum.
John Key said he wouldn't support it, and the Labour Party then changed its mind and withdrew support, says John.
With both major parties refusing to support his Bill, John has decided to delay placing his Bill before the house and instead to gather public support for a law change that reflects the ballot.
The campaign includes public meetings with the third one this week in Tauranga.
'The first meeting was in Labour leader Phil Goff's Mount Roskill electorate,” says John, 'where more people voted ‘no' than actually voted for Phil.”
'More people voted ‘no' in Tauranga than voted for Simon Bridges, and it was the same in every electorate, bar 14.”
The anti smacking as it stands is contradictory says John, and John Key himself describes it as a ‘dog's breakfast'. It states that parents can use force that is reasonable in the circumstances and gives some circumstances as examples where parental force might be used.
It states nothing in the section justifies the use of force and that the police have discretion.
It is badly written law says John. While the police are granted discretion, the government agency Child Youth and Family have no such leeway.
'There have been over 1000 investigations by CYFs of parents who have been reported smacking their children,” says John.
