Court proceedings for EBOP school

Judicial review proceedings are being filed on behalf of Kawerau Intermediate as the battle continues between the school's community and the Ministry of Education.

The school's board of trustees has lodged an application in the High Court at Rotorua for the courts to look at the process the ministry took before it came to its decision to close Kawerau Intermediate.

There are claims the ministry didn't listen to the community throughout the consultation process when the town's schooling restructure was under scrutiny.

The ministry is planning on closing the school at the end of the year and merging it with the college to create a single school on one site.

Kawerau Intermediate principal Daryl Aim says they are fighting for the school because the merger is not the option the community chose.

At the beginning of 2010, then Education Minister Anne Tolley announced she was going to merge the schools in Kawerau due to falling roll numbers.

She presented the community with three options and requested feedback from the public on these options before making a decision.

Anne then decided to merge Kawerau Intermediate and Kawerau College, as well as amalgamating three primary schools to one.

Daryl says Kawerau Intermediate has fought hard to keep the school open, but all attempts have failed.

He says the only other option is to go to the High Court in a last ditch attempt.

Data gathered through three Official Information Act request is being used to form the base of the appeal to the High Court.
