Council files charges in Bella Vista saga

Tauranga City Council has filed charges against parties involved in the Bella Vista development at The Lakes.

In a statement released this morning, council says it has filed charges in the district court.

"The charges relate to non-compliance with the Building Act and were served on the parties today.

"The council will not be commenting on the prosecution while it is before the Court."

Council signalled its intention to prosecute the developer last month.

Twenty one houses in the Tauranga development were deemed to be dangerous and were evacuated in March.

Since then it's been revealed the houses, some which had code compliance certificates, were shoddy and unsafe.

If the Council had done their job properly, in the first instance, it would never have come to this.

How did this land with Titles issued get transferred from a Company owned by father in law Paul Adams when the sites had no Engineering Certs for housing development. My subdivision had to have signed off engineers fit for housing certificates before Titles were issued and the land on sold?

The Council is a fool to take these people to court they will be exposed and will be found wanting in the courtroom,the legal advice that have received is flawed.

Why then are the council taking him to court !? You can't get blood out of a stone - what a futile step to take. The council was as much at fault as the builder in passing the 'shoddy' workmanship (or is it workpersonship now?) What a stuffed up world we live in !! Will TCC use the council lawyers - or hire some high flying 'specialist'. Pity the poor home owners - this is going to drag on for years at phenomenal expense all round. Ratepayers expense. Shame on TCC !!

How convenient cannot comment because its before the Court.............but not an excuse to not sort out the home owners which should be treated completely separately and urgently. By the time this gets to Court the CEO will be long gone...........very convenient !!!
