Flogged flag found

Tauranga's custom alternative flag snatched from the Takitimu Drive flagpole about lunchtime today, has been relocated.

The person who claimed to be the man seen breaking into the flagpole's halliard hatch announced he was going to drop it off at a Papamoa house this afternoon.

Even if it is returned in one piece, there may not be a flag flying from the flagpole on Monday.

Council property staff were checking the rigging this afternoon and don't know yet if there will be any flag flying from the flag pole tomorrow.

Mayor Stuart Crosby is unsure if the 3m by 6m custom made flag will fly again.

'We have retrieved it and it will be back in the office tomorrow, undamaged,” says Stuart.

'By tomorrow we should receive independent legal advice as to whether we can continue to fly it or not. If it says ‘yes' we will continue to fly it, if it says ‘no' then we won't. My intuition says that flag won't go up again.”

The council's legal authority to fly the alternative flag is under challenge by Mount Maunganui resident Rob Paterson who says the flagpole's resource consent is for the New Zealand national flag only.

'As soon as it's safe to put back up, the national flag will go up and stay up, permanently,” says Stuart.

'The only reason the council was flying them alternately was to create debate. And I encourage people to vote. Personally I found it useful to see at a scale where you can have an opinion on it.”

It's not known yet who took the flag, but there are reports of people photographing the event says Stuart.

He's opposes the council flying it because he argues the resource consent for the flagpole only permits the New Zealand flag to be flown. He knows because he opposed the flagpole from the beginning as an unnecessary cost to ratepayers and submitted on the flagpole at the resource consent hearing.

He's made public correspondence between himself and the council over the issue, where he says flying the alternative flag is an illegal act by the council – which is also responsible for policing the flagpole consent.

'Tauranga Council is the consent holder, and also the consenting and enforcement authority yet it saw fit to use one of its TCC staff members to justify the inane conclusion that the silver fern referendum flag is in some way an alternative NZ National Flag – it is not,” says Rob.

The flagpole was once property of Woolworths Cameron Road but was taken down when Countdown took over. Peter Farmer representing the Tauranga Community Flagpole Trust was the instigator of the original flagpole project, says Rob. That Trust eventually paid for the flagpole relocation and reconstruction on the Takitimu Drive roundabout.

But the $5000 a year maintenance cost for the purchase of new flags, banners, repairs and maintenance, is met by ratepayers says Rob.

Hate to say I told you so. So Stuart Crosby's intuition is that the NZ national flag will go back up and stay there. It should never have been removed in the first place. I do not believe his statement that the alternative flag was put up to create healthy debate. This is the last thing it did. I believe My Crosby is looking for an out. Peter Farmer should take the flag back and stick it on his own property.

$5,ooo a year maintenance for what it is only a pole, maybe TCC send staff down there with fluro jackets and clipboards and give it a little rub,i say take it away and make roundabout smaller to let those long RIGS get around safely thankyou sunlive

Rob should fund the flag pole, lots of these rich people want a say but dont put their money where there mouth is and help donate, i support change n agree with the only councilor to say no ( Steve Morris ) that only the current national flag is to be flown, and adding to that the person who took it down should be charged accordingly

If you are only going to get legal advice tomorrow why did you fly it with just the flag consideration panel advice.This reeks of supporting the national party by the council.We are not simple we can and have enough time to make a decision with out all the crap we have had over this referendum.

If people are so hooked on the old flag they don't have to abuse other NZ people of their rights. Its everyones right to be part of a democracy and freedom of voice or choice. The system is there for everyone to vote just like an election. The flag pole doesn't belong to or paid for by the council its belongs to a trust just maintained by the council rate payers who all have an equally say. If Rob Paterson wants to go down the legal road there is another side to look at. Under PC law its illegal to display an offensive symbol that is racist. The union jack is just that no different to a lot of people then the Nazi symbol. If you want to support this type of corruption your law is an ass or joke. Come on all NZrs get rid of the NaziJack.

When I rang the flag Consideration Flag Panel, I was told that if the opposing flag was to fly, it was to fly it was to fly alongside or below our current flag. He states that they will seek independent legal advice and his intuition tells him the flag will not go back up....wonder why? should have done his homework first.

I phoned the council to complain that it should never have been there and was told the councilors had a vote and the pro change flag brigade ( Key sychofants) easily won. I then had a vote here at home and we all voted not to pay our Rates, so I guess that's OK then? Good on you Mr Paterson.

I agree By The Sage, Mr Crosby is not sitting again and and wonder what else he has signed off before he goes, i believe TCC building will be demolised and a 1,000 seat auditorium will be built there,2 days after they moved from there ,there was a front page in paper saying cost $ 2million so far gosh it is out of CONTROL THERE, Thankyou Sun Live

How do you feel threatened by the old flag brigade.....The Mayor states that the consents pertained to the OLD FLAG, so we were lead to believe he had permission to fly the opposing flag.....oh dear, today, he is seeking legal advice. You have nothing to fear from people who just want the process to be FAIR and unbiased, and even LEGAL....Everyone will vote however they wish. The ONLY DAY OF DEMOCRACY is the day of VOTING.

Funnily enough, apart from the spelling mistake those were my exact thoughts when John Key told the flag consideration panel that his favourite was a silver fern.

What a bunch of killjoy miserable nitpicking people with nothing better to do than moan. A resource consent stating you shall only fly the NZ flag is about as sensible as what colour clothes you can hang on your washing line. I have no problem with giving the public a choice and with them seeing that choice properly flown before they make their decision. Some people are simply PITAS (pains in the .....) and it's about time somebody said so.

Hang on a minute mate, in the first line you abuse "moaners" then in the second line you moan about the RMA. What is it you want us to say or do exactly? And does it include you, or are you perceived to be exempt? Be objective and debate the flag.
