A 47-year-old man who was spotted by a woman running naked in a forest near Tauranga last year has had his second appeal upheld in the High Court at Tauranga yesterday.
Andrew Lyall Pointon, a naturist for more than 20 years, was found guilty of one charge of offensive behaviour in Tauranga District Court last December after running naked through Oropi Bike Park in August.
He was seen by a woman who felt offended and threatened and lodged a complaint with police.
Three days later Pointon was arrested.
Yesterday, Justice Paul Heath upheld a second appeal made by Pointon in the High Court at Tauranga, following a rejected appeal in June.
Pointon drew attention to himself in March last year when he organised a nude bike ride on the same day as a surf lifesaving event, resulting in residents threatening to form a human chain to prevent the ride.
He told SunLive at the time he did not know it was going to be a busy surf club weekend when he scheduled the naked bike ride.

All those naturists who cry "what's wrong" need to put themselves in this poor woman's shoes. She must have been scared to death seeing a naked man running towards her through the forest. He should be sent to prison naked if he likes it so much and see what that gets him.

I don't like a movie i change channel or turn off. The woman obviously looked long enough to give police a description. Although I would not do myself but I don't go looking for it either. I only look at what I want too.

Fully agree pomfart feel free to do this at home but not in the local parks. To a woman walking alone this would be most disturbing, I would have called the police to.

Nudity is not illegal. The nude body is not obscene. Obscene is Victorian attitude in this day and age, especially if the rightful liberty of the individual is harassed and obstructed. This man was jogging nude. So what? He did not behave offensive or address that woman. So you really think a woman walking alone in the forest, who sees a naked man coming towards her, should.........look away!! You clearly do not have the required brain cells in order to empathise with a woman who might find herself in such a situation. I suppose you think woman who wear a short dress are asking for it too?

Appears to be in the same league as all those over 60 year old men who insist on getting naked and lie in wait in the sand dunes to stroll down to the waters edge just as a woman walks by.. Exhibitionists one and all. Naturist? Nah! sexual thrill seeker? Yup!
