TCDC amends Cemeteries Bylaw

The Thames-Coromandel District Council says two minor changes to the Cemeteries Bylaw 2015 will help tidy it up and make things clearer.

One amendment refers to an error in the specified maximum width of a casket for ashes in clause 14.11 of the bylaw – changing it from ‘10mm wide' to ‘100mm wide'.

The other amendment made was to to clause 15.1. which reads: ‘The Funeral Director, or those responsible for funeral arrangements must ensure that the remains are in a suitable receptacle when presented for interment...'

Council has now changed the wording to: ‘The Funeral Director, or applicant responsible for funeral arrangements...'

'This change gives clarity as to where responsibility lies but doesn't change the intention of the clause,” says council.

'The Local Government Act allows council to make minor changes to bylaws or to correct errors by resolution if they don't affect an existing right, duty or status of anyone to whom the bylaw applies.”

Council adds any changes beyond this, for example, any that alters the meaning of a specific clause of the bylaw, would require a review of the bylaw.

The Cemeteries Bylaw which was adopted in May 2015 is not scheduled for review until 2020.
