Bikers on trial for home invasion

A man who denies involvement in a home invasion which left a victim with injuries so severe his right eye had to be removed, was threatened with being found in contempt of court at his jury trial on Friday.

Police raided the Filthy Few Motorcycle Club in December 2013.

Jay Beguely, 24, from Tirau, refused to answer Crown Prosecutor Julie O'Brien's question about who accompanied Beguely to look at a car on the Plummers Point property where Beguely is accused of taking part in a home invasion with Tama Waitai, 27, Takatu Ahomiro 38, of Te Puke, and Carl Tremayne, 43.

They are charged with committing a burglary with a weapon, wounding with intent to cause grievous bodily harm, injuring with intent to injure and threatening to kill.

Beguely, Ahomiro and Waitai are each facing single counts. Tremayne is facing two counts of the same charges. Two men were injured in the attack.

The four are accused of forcing their way into a home on Plummers Point on December 22 2013, and beating the two occupants while armed with a torch, pinch bar and knuckle dusters.

Beguely claimed his partial palm print was located on a mag wheel rim on the property because it was in a black Porche he was looking at buying.

Judge Christopher Harding warned Beguely he could be found in contempt when he refused to say who was with him when he looked at the car. The judge called for an adjournment asking Beguely's lawyer, Paul Mabey, QC, to talk to his client about the repercussions he faced.

Beguely continued refusing to answer after the break saying he was not going to nark. The Prosecutor withdrew the question so she could continue her cross examination.

Julie challenged Beguely's assertion he was a full patched up member of the Filthy Few Motorcycle Club, saying the club's dairy shows he was taken on as a prospect only in May 2013, and that at the date of the assault on December 21 2013, he was still a prospect.

'You went to Plummers Point on the night because this was a way to get your patch, since you have been a prospect since May,” she said.

'Not at all,” said Beguely.

In her cross examination, Julie told the court police pictures taken of Beguely's room at the club's Birch Avenue pad on December 24, 2013, show a brand new shiny club patch on the bed.

She put it to Beguely that his participation in the assault was the event that earned him his patch.

Beguely denied the prosecution's claim saying the badges on the front of the leather vest are weather stained, showing they have been there for a while.

He said the knuckle dusters police found in the room are a belt buckle, the handcuffs were bought from a $2 type shop, and the balaclava he wore while riding to protect his face from windburn.

Beguely claimed he was living in Tirau at the time and commuting to an engineering job at The Mount. He stayed at his room at the club's pad only from time to time.

Julie said the room, its clothing and the fact he had a Christmas card there, makes it likely Beguely was living at the pad, and that his Tirau address was to keep the Department of Corrections from recalling him to prison for breaching his parole conditions.

Beguely denied the claims.

Julie moved on to cross examining Beguely on the timing and contents of phone texts made on the night and early in the morning following the attack.

The contents she said reinforced the view that Beguely is the prospect taking orders from more senior club members.

Saturday night texts from Tirau indicate Beguely was there to pick up a gold coloured Torana that belonged to his father, a patched Filthy Few Motorcycle Club member.

'Texts sent and received in Tauranga in the early hours of December 23 show he was still taking orders,” said Julie.

'After you had done the job at Plummer's Point you were still taking orders, because at that point you were still a prospect and part of what had gone down that night,” she added/

'I wouldn't take orders from anyone,” responded Beguely.

The trial, which began last Monday, is expected to finish on Monday.
