Murder accused feared for life

The jury in the murder trial of accused Tyrone Daniel Flavell today heard of his fear of the Mongrel Mob and his wish of 'wanting it to all end”.

In a video interview, 19-year-old Tryone told police he grabbed a shotgun from his back seat and a bullet from the glove box of his truck after a man approached him in Maketu down by the beach and threatened his life.


Isaac Bushell's body was found in a park in Maketu last year.

'I didn't mean to kill him,” he says.

Flavell is charged with murder in relation to the death of Isaac Dale Bushell on December 8, 2013.

Bushell's body was found in a park by two people off Maketu Beach Road around 1.45am after he suffered a fatal wound to his chest.

Flavell was arrested after police stopped him and four other people leaving the area shortly after the body was discovered.

In giving evidence this morning, Senior Constable Kane Caulding described how he stopped the vehicle on Maketu Beach Road and noticed that Flavell seemed agitated as he sat in the back seat.

'I was alarmed at his behaviour so focused my attention on him,” said Kane. 'He seemed agitated, wide eyed and was sweating.

'I asked him about the cuts on his face and he said he got them in a fight at a party.”

Kane then advised Flavell of his rights before continuing to question him about what happened.

Back at Tauranga Police Station, Flavell was interviewed by Detective Graham Dunn and he admitted to loading a .12 gauge shotgun, pointing it at Bushell and pulling the trigger.

He said Bushell was of solid build and he feared for his life.

'I didn't know who he was. I had seen him around Maketu but didn't know what his name was,” Flavell said in the video interview.

Bushell was a friend of patched Mongrel Mob member Darkie Cable and the ex-boyfriend of Sam Reid, a girl Flavell had been seeing.

In the video statement, Flavell went on to say how he had been getting death threats from Cable since he had been seeing Sam and had been warned not to go out with her.

Flavell and Sam had been parked down at the beach in Maketu when Bushell approached the pair at around 1am.

'This man (Bushell) was yelling and swearing as he came to the truck,” Flavell explained. 'He came around to the passenger side of the truck and said that I was f***** and Darkie was going to kill me when he got out.”

Flavell ignored Bushell, who walked away but came back a second time, reached through the open passenger window and punched Flavell twice in the face.

'I feared for my life. He made me feel little and I just wanted it to end,” he adds.

Flavell exited his truck and pointed the loaded shotgun in Bushell's direction. Flavell said Bushell walked up to the barrel of the gun and said 'you think you're the man with that gun”.

'I pumped it, put a bullet in the spout and pulled the trigger,” he says.

'I just wanted it to end, I wanted the Mongrel Mob to leave me alone. I felt threatened and didn't know what to do.”

After Flavell fired the gun Bushell told him he was f***** and that Darkie was going to kill him.

He adds: 'He walked off towards the park. I got back in the truck and Sam and I drove off.”

Flavell told Detective Dunn that he ditched the shotgun in the water before returning to a party he had been at earlier in the night.

The video statement will continue to be played this afternoon.

The Crown is expected to finish its case tomorrow morning before delivering closing arguments tomorrow afternoon.

The judge is then expected to sum up on Thursday morning.
