Maori seek Mount Domain

Maori today signalled their intention to seek ownership of the Mount Recreation Reserve at the base of Mauao from Tauranga City Council.

The 5.5 hectare slice of land along the base from the Mount Surf Club to Adams Avenue, including the holiday park and hot pools, is currently owned by Tauranga City Council.

Ngai Tukairangi hapu are seeking title of the Mount Recreation Reserve at the base of Mauao.

It was left out of the agreement to transfer ownership of the Mauao Historic Reserve to Tauranga Moana's three iwi in 2008.

Ngai Tukairangi hapu representatives at the Tauranga City Council/Tangata Whenua Committee informal forum held on the Waikari Marae today, say the Council's ownership is the reason why the reserve was left out of treaty settlement negotiations.

Josh Gear and Riri Ellis say the interest is in only the title ownership, and say public access and the commercial operations of the holiday park and the hot pools will continue uninterrupted.

'It will be business as usual,” says Riri.

Josh says the handing over of the Mauao Historic Reserve to iwi is successful because of the good relationship between the Tauranga City Council and local iwi. They expect that to continue with the recreation reserve, with the hand over having no effect on the general public.

'Essentially what we're after is just the title,” says Josh.

The Ngai Tukairangi hapu's request to begin the conversation is supported by Ngai te Rangi iwi.

Speaking afterwards Mayor Stuart Crosby says the hapu request is not unexpected. While a council agreement in principle is possible before the elections, the Crown will also have to be involved.

Josh's says Mauao and its surrounds was taken by the Crown in 1865 under the New Zealand Settlements Act, in an act the Waitangi Tribunal later adjudged, 'poignant treaty breaches”.

The confiscation retrospectively validated by the Tauranga District Lands Acts of 1867 and 1868, which declared the entire district of 290,000acres Crown land, but provided that three quarters be returned to Maori ownership in accordance with promises made by Governor Grey.

The Acts also provided that land not retained by the Crown be returned to Maori after ‘due inquiry'.

The Mauao Recreation Reserve was part of the Waikorire Block awarded to Ngai Tukairangi about 1880.

The next Crown Commissioner, commissioner Brabant, granted title over Waikorire to 50 people instead of to the hapu. Brabant was simultaneously the resident magistrate, the commissioner of Tauranga lands, and a Crown land purchase agent.

As Crown agent he then bought up the owner's interests. Maori were induced to sell since keeping the land meant they would have to pay to have it surveyed, a process as expensive then as it is now.

Josh's presentation states the Crown's purchasing strategy was in breach of the Treaty as was the means and the reasoning.

The Mount Maunganui Recreation Reserve was created in 1888. Josh says the government cited recreation, quarrying, defence concerns and navigation among the reasons why the Crown deemed buying Mauao necessary.

In January 1980 the recreation reserve was vested with the Mount Maunganui Borough Council at no cost, which was later amalgamated into Tauranga City in 1989.

The Mauao Historic Reserve was returned to Tauranga Moana iwi in 2008.

At the time Ngai Te Rangi said support was conditional upon the recreation reserve being set aside for Ngai Tukairangi to pursue, and the hapu's interest is recorded in the Mount Hot Pools memorandum of understanding of December 2008, and the Holiday Park memorandum of understanding of September 2010 between Ngai Tukairangi, Ngai Te Rangi and Tauranga City Council.

There needs to be another 'land recognition type' established that better meets Tangata Whenua and the community aspirations, for today and in to the future. To rely on the european title, legal ownership with defined european boundaries is too divisive and restricting. The present approach will have far reaching ramifications throughout our region, acknowledging the many and varied areas of historical and cultural significance.

As far as looking after land, i'm not into gorse, graffiti, or junk on my property, i don't allow it. I live in the BOP and a lot of land has been given back to (part) maori, gorse, graffiti, and junk, is the norm on that land unless we pay for the up keep, a drive in to Rotorua is a good example. If the tfr of title went ahead, I doubt very much it would happen BEFORE the next round of local elections. Who would want to put their head above the parapet on this idiotic idea. They ONLY want Title ownership? They would then claim that the financial profit of the campground would be used to finance restoration work as an argument. Like the foreshore and seabed Act that gave ownership to everyone regardless of colour, reserves are for everyone. I see that Motuotau (Rabbit) has just been given back as part of settlement. As it is a scenic reserve managed by DOC, will the new owners now carry out all pest control and monitoring of wildlife at their own expense and make the immediate area a marine sanctuary with a no take policy? for anyone (not a bad idea?)

It seems like the general consensus here is this has got to stop. With this racist word being thrown around, it's hard not to feel that way with the content in this article. Most New Zealanders these days have embraced the Maori culture whether from European descent or anywhere else but there is a point where it has to stop. This land is owned by the council, it is there for EVERYONE to use and these comments keep driving the wedge. The Maori are trying to claim back the land and want to charge for the water we drink and air we breathe, why can't the European start charging the Maori for the english they speak, the buildings they build, culture, education, medicine, technology etc etc they use? Seems silly eh? That's how we feel. Build a bridge, put the past behind us and move on together.

Pre European maori had a poor conservation record. Not sure where this myth started about maori caring for the environment, but the Moriori and the Moa would certainly disagree. We all know that maori want the co-management debacle with this land. That's where instead of a tollgate at the Mount, they steal from the ratepayers by stealth thanks to a council that agrees to endless meetings, consultations, hakas, blessings etc etc. This land belongs to the Council and it must not be gifted to the mafia.

But Maori already own most of it, how come they haven't put up shacks, they are maori they do that sort of thing you know. Wow its still there go figure. And whats that you say I can still walk around it and have a picnic on the beach. No way, really???, I was thinking of taking $2 along for the toll booth, now I can buy an ice cream instead. One thing is certain, Mauao will be there long after all of us and this type of discussion is good but it doesnt matter much to the mount.

Looks like that feeding frenzy via Wellington and the Waitangi Tribunal maybe starting to dry up so this must be the first serious attack by local IWI (I Want It) at TCC, fancy demanding that TCC have meetings and pay them to be there then turn around and then seek to take all? It) AVARICE People of Tauranga don't be fooled this is a plain and simple voluntary gifting proposal to squander TCC Ratepayers valuable public assets by some of your elected Councillors, and not a mandatory statutory legal process. Mount Recreation Reserve is presently freely available for use by all Tauranga citizens (and others) and let's keep it that way. To any TCC Councillors or TCC administrators who have foolishly taken part in any recent secret meetings (no transparency & no warnings) with Government representatives or vested maori interests on implementing this scam you are on notice that you will face a backlash at the upcoming Council Elections. If a memo of understanding is reached prior to the elections it can simply be reversed later. Recently TCC ratepayers spent $4m plus upgrading the Mount Hot Pools. Community never received any tangible input or contribution from iwi and then on cue percentage maori rock up, and say 'oh we think we would like to have title to that land” !! Mount Reserve and Mount Maunganui improvements have been put in place by the hard work of past generations of local citizens, both residents and ratepayers from all sectors. I have just been reading these comments and the racist anger is really distressing. We have a tribunal to deal with past grievances - so it can be sorted out in a calm manner, with all the info and then addressed. The Mount was confiscated illegally - it is only right it goes back to its owners. In this case a local iwi.

The recovery of land from the next source, it has always been said that land held by Phsuedo government agencies would only be claimed if they attempted to sell them, as far as I can see this is very bad at a principle level, i.e. that the essence is that what was stated before means nothing and all is up for grabs. Private lands will be next very much like what happened in Rhodesia and late South Africa.

So do I take it you could be referring to the fate of the Spainish Armada a couple of centuries ago. They took the wrong way and ended up on the rocks in Ireland and Scotland, at the time considered to be "barbarians" who surely then sorted the problem out properly so as finished off what the sea left behind. PS at least the Spanish got there with a real ship of their own and did not have to be dumped off randomly on some island because of no use to anyone from the start of the journey.

In Northland and the East cape areas the story was always smoozed over by saying "fee access for the public is guaranteed ..." but as sooon as the title changed then out came the turnstiles and a few likely lads to ensure everyone paid. In the end people just stayed away and the beaches whent o rack and ruin. So what was achieved? Certainly the trust was gone, so well who can disagree with the same entry point on the path and the same words spun out via the media as usual, "IF" it all happens as demanded then watch this space ... read my lips ... history will repeat. This is like a cancer of greed and self indulgence that moves and slithers endless consuming all permitted without reason, ligic or most importantly with genuine care for the land. If the land actually meant so much to Maori then why did they even sell a single piece of it, why once returned to them did they sell it again and again? Perhaps everyone else is silly here, but the obvious is obvious right!

The only iwi that should be consulted over the future of the domain are Ngati Ranginui. It was their tupuna, Tamatea Arikinui, who arrived on the Takitumu waka and laid original claim to Mauao. Ngaiterangi later took it by stealth and treachery. They are now using the same tactics to try and get it back again.

If you want to stop this endless process of redress become a republic ! Then N.Z will no longer be ruled by the crown and therefore not responsible for any percieved crimes that the crown commited. The peoples looking for redress will have to board a plane and fly to england to state their case. Either way the public and goverment of New Zealand will no longer responsible for treaty breaches as they are no longer an agent of the crown. That way you can move forward together as a united and one policiy for all nation known as New Zealand. Time to come into the twenty first century and have a truely multicultural nation, instead of a screaming divided welfare basket case that nobody benefits from besides one section of society,thus causing great disunity amongst the community.
