$100K in logging death sentencing

Whakatane-based firm Puketi Logging has been ordered to pay $75,000 to the family of Eramiha Pairama.

The 19-year-old was killed instantly when he was struck by a log attached to a harvest-line hauler that had snagged on an obstruction and rebounded into him on January 11, 2013.

Appearing in Tauranga District Court on Thursday, the logging company was also fined $25,000 following a successful prosecution by the Council of Trade Unions that took place in the same court in August.

Judge Robert Wolff said it was clear Puketi Logging, under the directorship of Whakatane businessman Lawrence Harper, had dramatically failed Pairama who was working alone and out of sight of his supervisor the day the fatal accident happened, reports Stuff.

'He was inadequately trained to deal with that sort of log. He should not have been left alone by the foreman that day.”

The private action was brought against the company by CTU president Helen Kelly, after WorkSafe NZ chose not to prosecute the company at the time.

Reading a victim impact statement in court, Eramiha's mother Selina Eruera that since her son's death, it had been extremely stressful for her and her two younger sons.

She said there is still a long way to go to achieve any sort of resolution.

'This has become a dark cloak over me. Anger and confusion continues to cloud my thoughts constantly,” Stuff reports her saying.

'I'd give up everything I own to have my son back with me.”
