Jailed for sexual assault

An Eastern Bay man found guilty of sexual violation has been sentenced to five years jail.

Guy John Porter, 29, was sentenced on one count of sexual violation by unlawful sexual connection, male assaults female and injuring with intent when he appeared in Tauranga District Court.


An Opotiki man found guilty of sexual violation has been sentenced to five years in jail.

He was also sentenced on charges of driving while disqualified and driving with excess breath alcohol.

According to the summary of facts, the incident happened on the night the female victim was at an address in King Street, Opotiki, on April 18, 2013, with two others who lived at the property.

The three had closed the curtains and doors at the property to allow for some privacy from the neighbours who were having a party.

Porter went to the address and repeatedly banged on the windows, demanding to be let in. He was eventually let in, intoxicated and holding a bottle of beer.

While at the table, Porter began verbally abusing the victim, calling her a 'hoe-bag” and referring to his uncle.

He then used his lit cigarette to burn the victim on the lower leg, causing a small round burn mark. Another woman at the property intervened and told him to leave.

Later in the evening, the victim was standing near the garage of the property when Porter called her ‘ugly' and a ‘slut'.

He grabbed the victim by the hair, causing her head to hit the garage and then she fell to the ground.

Porter held the victim by the back of the head and put his hand down her jeans. The victim tried to stop him, but Porter was stronger.

The summary says Porter then wiped his finger on her face, before getting up and telling others around to smell his finger.

The victim suffered various bruising on her body as well as a burn on her lower leg. She also had skin loss in her genital area.

When police questioned Porter, he said he had been trying to get the victim to leave and he had forcibly removed her from the address and shut the door.

He denied any physical or sexual assault.

In court yesterday, Judge David Ruth said the assault was more about humiliating the victim and not sexually motivated.

Along with the jail sentence, Porter was disqualified from driving indefinitely and an order for forfeiture of his car was issued in relation to the driving charges.
