Discharge over court order breach

A Tauranga professional is seeking a discharge without conviction after admitting he breached a parenting order not to contact his son.

The man, in his 50s, also filed for permanent name suppression in the Auckland High Court on the basis it would harm the charity he is involved in.

At a court hearing earlier this year, the man admitted to breaching the order after he sent his son a book with a message in it.

The breach happened with the man got his daughter to pass on the book to his son.

The man's lawyer, Paul Mabey, QC, says the message was a loving one sent from a father to his son and he hadn't fully read the court order.

If successful, it will be the man's second discharge without conviction after he first came when he was charged with assaulting his son last year.

A judge is expected to deliver his decision on August 14.
